Medistat NY provides information concerning healthcare-related professional and administrative services, including virtual telehealth support, LCHSA and FI requirements, CHHA and therapy service evaluations, DME prescriptions, transitional care management, and in-facility monitoring. Website descriptions are general and may not describe every qualification, limitation, requirement, or term applicable to a particular service.

The availability and scope of services may depend on professional judgment, eligibility, contractual arrangements, licensure, location, payer requirements, and applicable law. We may modify, suspend, or discontinue any portion of the public website or Services at any time.

You may enroll only through a method that clearly asks you to provide affirmative SMS consent, such as voluntarily selecting an unchecked text-message consent box on a Medistat NY form or completing another disclosed opt-in process. Consent to receive text messages is optional and is not a condition of purchasing any goods or services. Agreeing to these general Terms, submitting a form, or initiating contact with Medistat NY does not by itself constitute SMS marketing consent unless a separate, clear opt-in is provided.

Medistat NY does not share, sell, rent, or provide your mobile telephone number, SMS opt-in information, or messaging consent data to third parties or affiliates for their marketing or promotional purposes. Information may be provided to vendors, carriers, aggregators, and platform providers only as needed to deliver and support Medistat NY's messaging program. SMS Is Not an Emergency or Secure Clinical Channel

Do not use SMS for emergencies. Do not send sensitive medical information by text unless Medistat NY has expressly directed you to an approved channel. Call 911 for a medical emergency.

9. Intellectual Property

The Services, including their design, text, graphics, logos, images, software, and other content provided by Medistat NY, are owned by or licensed to Medistat NY and are protected by intellectual-property laws. Subject to these Terms, Medistat NY grants you a limited, revocable, nonexclusive, nontransferable license to access and use the public website for lawful informational and business purposes.

No other right or license is granted. You may not copy, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit Medistat NY content without prior written permission, except as permitted by law.

Medistat NY does not control and is not responsible for third-party content, availability, security, or practices. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDISTAT NY'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE PUBLIC WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
